"Thank you again for your tremendous efforts. I truly appreciate your support.”

On March 17th, 2026, we received another EB-2 NIW (National Interest Waiver) approval for a Graduate Research Assistant in the Field of Agricultural Water Management (Approval Notice).

General Field: Agricultural Water Management

Position at the Time of Case Filing: Graduate Research Assistant

Country of Origin: Nepal

State of Residence at the Time of Filing: South Dakota

Approval Notice Date: March 17th, 2026

Processing Time: 6 months, 2 days (Premium Processing Upgrade Requested)

Case Summary:

Recently, we had the privilege of representing a Graduate Research Assistant from Nepal, whose case illustrates how a targeted legal strategy can overcome a challenging Request for Evidence (RFE).

The Vision: Securing the Future of Food and Water

Holding an M.S. in water resources engineering, our client dedicates his career to mitigating the compounding global threats of water scarcity and food insecurity. His proposed endeavor is to develop integrated modeling frameworks that combine machine learning and process-based models using advanced remote sensing techniques.

Through this endeavor, he aims to improve agricultural water management, optimize crop yields, enhance water use efficiency, and support increased food production in water-limited regions. Because approximately 30 million people in the U.S. alone live in regions lacking sufficient surface water, his work is of clear, substantial merit and national importance.

The Initial Submission: A Strong Foundation of Evidence

When we initially filed his petition, we presented a highly productive academic portfolio. He had documented the results of his work in 9 peer-reviewed journal articles, 1 first-authored conference article, 2 conference abstracts, and 1 book chapter. At the time of filing, the scientific community had already cited his published body of work 78 times.

The Roadblock: A Stringent Request for Evidence

Despite this initial presentation, USCIS issued an RFE on November 13th, 2025. The adjudicating officer questioned whether our client was truly "well-positioned" to advance his endeavor, raising several critical objections:

  • Misidentifying the Field: USCIS erroneously stated that his endeavor involved "Artificial Intelligence and Agriculture," demanding proof of his standing in those distinct fields.

  • Questioning His Collaborative Role: The officer dismissed his achievements because the record did not show he was a Principal Investigator (PI) or had independently received government funding.

  • Dismissing Citation and Peer Review Value: USCIS argued that the record did not sufficiently prove his work had generated progress or widespread implementation in the field.

The Strategy: A Masterful Legal Rebuttal

North America Immigration Law Group (Chen Immigration Law Associates) immediately developed a comprehensive, data-driven rebuttal to deconstruct the RFE’s claims.

First, we set the record straight regarding his area of expertise. We clarified that his actual field is Agricultural Water Management, and that machine learning is simply an advanced tool he utilizes to achieve his goals, not the scientific field itself.

Second, we fiercely defended the collaborative nature of modern science. Utilizing non-precedent Administrative Appeals Office (AAO) decisions, we argued that USCIS was applying an arbitrary standard by penalizing the petitioner for not being a PI; co-authored contributions are highly valuable and cannot be lawfully dismissed.

Finally, we provided updated, irrefutable proof of his widespread influence. We demonstrated that his citation count had grown to 148, with an overwhelming 85.1% of those being independent citations from researchers around the globe. To completely neutralize the adjudicator's doubts, we presented advanced bibliometric models, definitively proving that our client’s citation impact placed him in the top 0.01% of researchers in his field.

By methodically addressing every concern with objective data and established legal frameworks, we turned a daunting RFE into a resounding success. We congratulate our client on his well-deserved NIW approval and look forward to his continued innovations in agricultural resilience.
